The 12th China Satellite Navigation Conference H03 Forum on BeiDou Rule of Law/Policies, Regulations, Standards and Intellectual Properties was Successfully Held

From May 26 to 28, 2021, the 12th China Satellite Navigation Conference was successfully held in Nanchang, with the theme of “Spatio-temporal Data, Empowers Bright Future”. A total of more than 2000 participants, including domestic and foreign officials of satellite navigation system authorities, experts and scholars in the field of satellite navigation, representatives of satellite navigation application companies etc attended this year’s CSNC. The three-day annual conference successfully held a series of activities such as academic exchanges, high-end forums, seminars and achievement expositions.

On the morning of May 27, H03-1 Forum on Beidou Rule of Law, guided by China Satellite Navigation Office, undertaken by BeiDou Policy and Regulation Research Center and  co-organized by WTO Law Research Society of China Law Society, was successfully held. The Forum was chaired by Yang Junlin, Executive Director of Beidou Policy and Regulation Research Center. Professor Yang Guohua from Tsinghua University School of Law, Professor Shi Jingxia from Renmin University of China School of Law, Liu Huaqin, Director of Eurasian Research Institute of Chinese Academy of International Trade and Economic Cooperation of Ministry of Commerce, Li Shouping, Dean of Beijing Institute of Technology School of Law, Xiao Jixuan, Deputy Director of National Defense Intellectual Property Office, Fang Yufei, Researcher of BeiDou Policy and Regulation Research Center, You Yuan, Vice President of Beijing BDStar Navigation Co., Ltd and other experts and scholars made speeches around the theme of “integrating domestic and foreign rule of law to actively promote the safety and application of satellite navigation”. Yang Guohua, Professor of Tsinghua University, Executive Vice President of WTO Law Research Society of China Law Society and Arbitrator of WTO MPIA, gave a presentation on “The Current Situation and Development of International Economic and Trade Rules”, introducing the important international rules activities in which China participates, including the Regional Comprehensive Economic Partnership (RCEP) Agreement, the EU-China Comprehensve Agreement on Investment (CAI), the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and the Joint Statement for U.S.-Europe-Japan Tripartite Partnership (TRI), which have influence on China's politics and economy.

Shi Jingxia, Distinguished Professor of Distinguished Scholar Program of Renmin University of China and Vice President and Secretary General of WTO Law Research Society of China Law Society, gave an invited presentation on “Legal Regulations of Satellite Navigation under the WTO Framework”. Professor Shi indicated that as a firm defender and supporter of the multilateral trading system, China's support for BeiDou's internationalization activities is consistent with the WTO obligations to which China is committed. The presentation examined the agreements and rules related to satellite navigation services under the WTO framework, including the General Agreement on Trade in Services (GATS) and the Agreement on Government Procurement (GPA), while focusing on the concerns of major WTO members have for BeiDou internationalization and analyzing China's relevant responses.

Director Liu Huaqin of Eurasian Research Institute of Chinese Academy of International Trade and Economic Cooperation of Ministry of Commerce gave a presentation on “Policy Environment, Opportunities and Challenges Faced by BeiDou Going Global - Case Studies of Russia and Central Asia”, introducing and analyzing the policy environment faced by BeiDou going global, starting from Russia and Asian countries, which have close cooperation with China  in terms of BeiDou internationalization. The presentation introduced and analyzed the policy environment, opportunities and challenges for BeiDou's future development, including friendly diplomatic relations, solid foundation for bilateral cooperation, and a wide range of areas of cooperation such as transportation, agriculture, environmental protection, disaster mitigation, cross-border e-commerce, border security and cultural exchange etc.

Li Shouping, Dean of the School of Law of Beijing Institute of Technology and Academician of the Social Science Division of the International Academy of Astronautics, gave a presentation on “Review of International Law on the Application and Promotion of Global Navigation Satellite Systems”, which analyzed and introduced the policies of the United States, Russia and the European Union on the application and promotion of global navigation satellite systems from the perspective of international law and the study of the legality of international law. Dean Li Shouping pointed out that the compulsory application of global navigation satellite systems does not violate existing international law and is an important means in breaking the monopoly of GPS on the application market through the compulsory compatibility with the U.S. GPS.

Xiao Jixuan, Deputy Director of National Defense Intellectual Property Office, gave a presentation on “Legal Risks and Prevention related to Beidou Global Services”, based on his long-term experience in the study of the national defense intellectual property system. Xiao first introduced the current situation of the application and promotion of BeiDou global services, and pointed out that there were many hidden legal risks in the development of BeiDou global services, such as ordinary legal risks, intellectual property risks and new legal risks. He also put forward practical suggestions to prevent the legal risks associated with Beidou global services.

Assistant Researcher Fang Yufei from BeiDou Policy and Regulation Research Center (Zhang Wenqing of Beidou Policy and Regulations Research Center delivered a presentation on her behalf) gave a presentation entitled “Cool-headed Thinking on Law against the Growing Popularity of BeiDou”, introducing through specific cases that BeiDou is currently facing two prominent problems that restrict its development, one is the lagging laws and regulations, such as legal norms in the field of surveying and mapping that restrict the realistic application of high-precision location-based services and the lack of relevant management systems for short message communication services. The second is the lack of legal regulations, for example, the fake Beidou incidents keep popping up, and the lack of special legal protection for BDS signals. Fang Yufei then offered thoughts and suggestions on the above specific issues.

Mr. You Yuan, Member of Major Special Project Application, Promotion and Industrialization Expert Group of China's Second Generation Satellite Navigation System and Vice President of Beijing BDStar Navigation Co., Ltd made a presentation entitled “The BeiDou Industrialization is In Urgent Need of Rule of Law Guarantee”, analyzing the current situation of the system faced by companies and putting forward several needs for rule of law guarantee for BeiDou industrialization. Vice President You suggested that the introduction of relevant policies, regulations and standards to regulate management, competition and brand cultivation was urgent, and that the rule of law would play a crucial role in enhancing the core competitiveness of BDS products and encouraging China’s BeiDou-related companies to go global.

In the afternoon of May 27, Yang Junlin, Director of BeiDou Policy and Regulation Research Center, Zhou Yuxia, Researcher of China Academy of Aerospace Standardization and Product Assurance, and Li Huiying, Director of Intellectual Property Office of National Industrial Information Security Development Research Center (Electronic Intellectual Property Center of Ministry of Industry and Information Technology), served as the chairmen of H03-2 “Policies, Regulations, Standards and Intellectual Properties” High-end Forum. More than 100 experts, scholars and representatives in the fields of policies, standards, intellectual properties and satellite navigation at home and abroad participated in the Forum and had in-depth discussions on the theme of the Forum.

The Intellectual Property Section concerns academic exchanges related to intellectual property management of BeiDou-associated companies, trademark layout, business secrets, and innovative applications. Invited presentations were made by four experts.

Director Wang Qiang from National Defense Intellectual Property Office gave a presentation entitled “The Role of Intellectual Property Management Requirements in Innovative Development of BeiDou-related Companies”, which elanorated on the role of BDS satellite navigation in the development of innovative applications etc based on the hotspot and key issues involved in China's intellectual property management, and proposed ways of protection and related suggestions for BeiDou-related companies in intellectual property management based on the current international situation.

Lawyer Wu Lili from Beijing Han Kun Law Offices gave a keynote speech on “Intellectual Property Management and Business Secret Protection Strategy for BeiDou-related Companies”, introducing the background of business secret protection for Beidou-related companies and analyzing the internal staff management and supplier management mechanism of BeiDou-related comapnies. In the end, Ms. Wu proposed strategies and insights for BeiDou-related comapnies in business secret protection based on the characteristics of the BeiDou industry.

In addition, Li Jia and Wang Yuxuan from the Electronic Intellectual Property Center of MIIT shared research reports on “The Role of BeiDou Patent Layout in Technological Innovation” and “Research on Trademark Strategy of BeiDou Industry” respectively on behalf of their respective teams. The presentations introduced the nature, role and way of patent layout of BDS satellite navigation in China respectively, and proposed that innovation was the first driving force leading development and protecting intellectual property rights was protecting innovation. At the same time, they analyzed the current status of BeiDou trademark applications and trademark litigation cases, and proposed methods and paths to improve the trademark protection mechanism from the perspectives of enhancing the awareness of trademark protection and combating malicious pre-emptive trademark registration and hoarding.

Four experts and scholars showed the achievements and experiences in protecting intellectual property rights in the field of satellite navigation in China from different angles and dimensions. The invited presentations delivered were in-depth and vivid, and the discussions were extensive and profound, which received enthusiastic reactions from audience onsite.

The Standardization Section invited seven experts in the field of satellite navigation standardization to give invited presentations. Senior Engineer Liu Ying of China Satellite Navigation Engineering Center delivered the presentation entitled “The Status Quo, Development and Thinking of BeiDou Standardization”, introducing the work of Beidou Satellite Navigation Standardization Technical Committee and the current achievements putting forward several thoughts and suggestions, and giving several key directions for the follow-up development of BeiDou standardization .

The presentation entitled “Thinking about the Development of Civilian BeiDou Anti-spoofing Terminal Industry Standardization” was presented by Shi Lei, Senior Engineer of Rocket Force Research Institute, who introduced the practical significance of civilian BeiDou anti-spoofing technology, technical means and the current situation of the industry, and put forward several suggestions for the development of BeiDou anti-spoofing terminal industry standardization.

Professor Liu Hui from the Research Center of Satellite Navigation and Positioning Technology of Wuhan University gave a presentation on “Progress of RTCM High Precision Differential Positioning and Completeness Standard”, introducing in detail the progress of international standards for differential data and the background and status quo of completeness protocols, and analyzing the requirements for completeness performance in the application area.

Senior Engineer Wang Zhixin, Director of Institute of Perception of CRSC Research & Design Institute Group gave a presentation entitled “Research on BeiDou integrated navigation in  high-speed train operation control system standardization”, introducing the current situation and practical significance of the application of satellite navigation technology in the high-speed train operation control system, analyzing the application of BDS satellite navigation technology in China's high-speed train operation control system and providing follow-up recommendations and outlooks for standardization work.

Researcher Jiang Xin from COMAC Beijing Aircraft Technology Research Institute made a presentation on “Research on the Application and International Standardization of BeiDou Civilian Airborne Equipment”, analyzing the importance of the application and international standardization of BeiDou civilian airborne equipment, introducing the progress and work plan of BeiDou international industrial standards, and offering the follow-up work plan and work roadmap.

Assistant General Manager of China Security and Anti-counterfeiting Certificate Development Center, Senior Engineer Cai Zhiguo, delivered a presentation on “A Preliminary Study of BeiDou Video Surveillance Application Standardization”, introducing the background of BeiDou video surveillance application standardization work, the current research progress and the next work plan.

Researcher He Xiongwen from Beijing Space Vehicle General Design Department delivered a presentation entitled “Research on the Protocol Architecture and Standard System of Next-generation Navigation Space and Intra-satellite Integration Network”, introducing the relevant research background and requirements, and giving recommendations on the protocol architecture and standard system of next-generation navigation space and intra-satellite integration network.

The seven reports of the Standardization Sub-forum reported from different angles and directions of BeiDou standardization, involving the top-level design of standardization, international standardization work, as well as the current application status and standardization research of BDS in industry fields such as high-speed train operation control, civil aviation industry, video surveillance etc, which attracted wide attention of the attending experts and representatives and achieved good results.
